Our representative matters include:
- Obtained dismissal of construction defect claims against developer of condominium in complex business court
- Prevailed at trial in complex business court, upheld on appeal, and recovered client’s attorneys fees, in case enforcing oral contract to purchase a marina in downtown Miami
- Prevailed at trial in Delaware Chancery Court, preventing shareholders’ attempt to wrest control of corporation from its founder, recovered the client’s attorneys’ fees
- Obtained summary judgment and recovered client’s attorneys’ fees on behalf of developer of luxury housing development, defeating home owners’ attempt to force turnover of the home owners association
- Obtained dismissal, in complex business court, of claims against master association of prestigious Miami Beach Hotel Condominium and Spa, defeating claims concerning the legal structure of the condominium
- Obtained summary judgment and recovered client’s attorneys’ fees in defamation lawsuit
- Successfully represented international hotel brand within “hotel-condominium” against residential association concerning legal structure of condominium
- Successfully resolved land purchase contract dispute on behalf of developer of prospective assisted living facility
- Represented purveyor of international tennis tournament against municipality’s attempt to void long-term contract; successfully resolved prior to trial
- Successfully represented developer in putative class action involving five condominium projects located in Miami-Dade, Palm Beach, and Lee Counties, seeking several hundred million dollars in deposits and damages
- Successfully represented condominium developers in dozens of lawsuits alleging violations of the Interstate Land Sales Full Disclosure Act, Florida’s Condominium Act, Florida’s Deceptive and Unfair Trade Practice Act, and a host of other claims in which many hundreds of plaintiffs sought to rescind their purchase contracts and to recover hundreds of millions of dollars in deposits as well as damages
- Successfully defended NYSE-listed Fortune 500 company at trial and on appeal in federal and state courts and before the Eleventh Circuit Court of Appeals regarding Interstate Land Sales Full Disclosure Act and related liability claims
